Terms of service

These Terms of Service ("Terms") govern your access to and use of Caketunes (the "Marketplace"), including every purchase, license, account and seller activity on this site. By creating an account, browsing a product page or completing a checkout, you agree to these Terms.

1. The marketplace

Caketunes connects independent producers ("Sellers") with artists, labels and creators ("Buyers"). Sellers list beats, sample packs, drum kits, bundles and services; each product is sold directly by its Seller under the license the Buyer selects at checkout. Caketunes operates the platform, processes payments and delivers files, but does not own the music listed on it.

1.1 Who can use this site

You must be at least 16 years old, or the age of digital consent in your country if higher, to create an account. By registering you confirm the information you provide is accurate and that you have the legal capacity to enter into these Terms.

2. Accounts

Signing in uses one-time email codes or a connected Google / Facebook account — there is no password to remember or lose. You are responsible for every action taken from your account, so keep access to your email and connected accounts secure.

  • One account per person. Buying and selling (if you apply as a Seller) happen on the same account.
  • Accurate details. Your billing email and name must be correct for receipts, licenses and support.
  • Closing your account. You can request deletion at any time; active orders and issued licenses remain valid and on record as required by law.

3. Purchases and licenses

Every order is completed through the checkout's listed payment methods. Once a payment is confirmed, the license terms shown on the product page at the time of purchase apply to that order — they are captured permanently and stay available in your Library, together with a signed license document.

  • Non-exclusive (lease) licenses let you release music with the product within the usage limits printed on the license (streams, units, videos, depending on the tier). The Seller can keep selling the same product to other Buyers.
  • Exclusive licenses remove the product from sale once purchased and typically transfer broader rights — the exact terms are always the ones shown on your license document.
  • Delivery happens instantly after a confirmed payment: files and the license document unlock in your Library. Formats available (MP3, WAV, stems, project files, archive) depend on the license and product type.

4. Refunds

Digital products are delivered instantly, so most sales are final once the files are downloaded. A refund may be issued when:

  • the files are corrupted, incomplete, or materially different from the product page;
  • a duplicate or accidental purchase is reported before the files are used;
  • a payment is reversed or declined by the payment provider after delivery — in that case the license is revoked and access removed.

To request a refund, contact support with your order number. Refund requests are reviewed case by case and a decision is communicated within a reasonable time.

5. Sellers

Anyone can apply to sell on Caketunes using their existing account. By applying and uploading products, Sellers agree to the following:

  • Ownership. Sellers must own, or hold a valid license to, every sound, sample, loop, recording and asset they upload. Uploading content you do not have the rights to is a violation of these Terms.
  • Accurate listings. Prices, license terms, BPM, key and included files must match what is actually delivered.
  • Payouts. Earnings are calculated on completed, non-refunded orders and paid out according to the schedule and method shown in the Seller dashboard.
  • Removal. Caketunes may remove a listing or suspend a Seller account that violates these Terms, infringes third-party rights, or receives a valid takedown request.

6. Prohibited use

You agree not to: upload or distribute content you do not have rights to; attempt to bypass licensing or payment; resell, redistribute or re-upload purchased files as your own product; use the platform for any unlawful purpose; or interfere with the site's normal operation.

7. Intellectual property

All music, artwork and content remain the property of their respective Sellers, licensed to Buyers strictly under the terms of the purchased license. The Caketunes name, logo and platform design are the property of its operator and may not be used without permission.

8. Limitation of liability

Caketunes provides the marketplace "as is." To the extent permitted by law, Caketunes is not liable for indirect, incidental or consequential damages arising from the use of products purchased through the platform, disputes between Buyers and Sellers, or service interruptions beyond its reasonable control.

9. Changes to these Terms

These Terms may be updated from time to time to reflect changes in the service or applicable law. Continued use of the platform after a change takes effect means you accept the updated Terms.
